Southwell Cakery Terms & Conditions

By paying a booking fee you are agreeing to our terms and conditions.
Prices
You agree to pay Southwell Cakery the price as quoted on your confirmation booking form and invoice.
Bookings and Date Booking fees
All Orders and Dates are only secured with a non-refundable booking fee.
Wedding cake quotations are valid for 14 days from date of issue. Unfortunately, due to the high demand for bookings, it is not possible to reserve you day prior to the payment of the booking fee. Alterations to the agreed quotation may be chargeable, dependant on time involved and cost of materials. Once booking fees are received and cleared your booking date will then be fully secured. Wedding cake booking fee is £100 (£200 for orders over £600), all other cakes the booking fee is 50% of the value of the order.
Final Payments
The full balance of wedding cake orders is due on or before one month prior to the cake delivery date as specified on your confirmation booking form. On your initial invoice and any subsequent invoices, the date of the full balance will be included and a reminder of the final amount will be emailed to you no less than 7 days before final payment is due. Failure to make payment of the remaining balance may result in your order being cancelled and your date being made available to someone else.
While every effort will be made to keep your order on track, late payment of the final balance may result in Southwell Cakery being unable to complete your cake by the required date.
Payment methods accepted are Cash, Cheque or bank transfer. 
Late or non-payment
Late or non-payment could result in loss of your booking date. In the event of a late or non-payment, the order will not proceed until alternative funding has been agreed and payment made in full. In these circumstances completion of the order on the required date cannot be guaranteed and becomes subject to availability. Every effort will be make to complete your order by the date initially agreed, however, Southwell Cakery cannot be held responsible for delays to completed order should this be due to late or non-payment.
Delivery/Collection
Wedding cakes will be delivered and set up at the agreed venue on the required date as stated on the confirmation booking form. The cost for delivery and set up will be included within your confirmation booking form.
If we cannot deliver the cake because there is no one to receive it or if the venue details are incorrect the cake will held for a maximum of 24 hours at my address. Should the cake not be collected or is unable to be delivered after this period, Southwell Cakery has the right to resell the cake.
Unless otherwise stated, non wedding orders should be collect at an agreed time from our studio, Southwell Cakery provide transport instructions but cannot take any responsibility for any damage sustained to the cake during transport, delivery and subsequent set up at the venue. The cake becomes the sole responsibility of the customer once it has left my premises.
For wedding cakes, set up at the venue will occur at an agreed time with the venue. The cake will set up in line with the details on the booking form and in the final location at the venue. The cake will be photographed in situ before we leave the venue and inspected by the venue management, Wedding Planner or any third party taking delivery etc. Any damage sustained to the cake after this time is the responsibility of the venue and not Southwell Cakery. Southwell Cakery are not responsible for any repairs as a result of damage sustained at the venue as a result of failure to follow instructions/advice we may give in respect of storage or setting up or further transportation of the cake.
Cancellations/Date Changes
Cancellation of your order one month or more prior to your wedding date or requested date, will result in the booking fee being retained only. The initial booking fee is non-refundable in any circumstances. Cancellations made less than one month before the agreed date will result in the full balance being retained. If the balance has not yet been paid, payment in full will be required.

Verbal phone cancellations will not be binding.
Change of Wedding/Order Dates
If for any reason you have to re-arrange the date of your wedding/order, we will try our best to accommodate these changes without any additional charges provided sufficient notice is given. If we are fully booked on your new wedding date and cannot provide the wedding cake, it will not be possible to refund your booking fee.

Stand Hire
Southwell Cakery have a range of cake stands available for hire. All stands require a deposit in addition to a hire charge which is fully refundable on return of the hired stand. The hirer is responsible for returning the hired equipment to Southwell Cakery within the agreed timescales. Any damages will be deducted from the deposit. In the event that the damages are excessive, or a loss has occurred then the deposit will be retained.
Allergies
Any special request such as “no nuts”, and “gluten free” will be met wherever possible. However, whilst your chosen cake will not be made with said allergens or products, no absolute ‘free from’ guarantees can be given, as some ingredients are not guaranteed ‘free from’ by the manufactures.
In addition, your cake will be made in a premise which handles allergens (NUTS, MILK, EGGS, GLUTEN, SOYA, SULPHATES), and Southwell Cakery cannot guarantee absolute free from conditions. Allergy information will be provided with all orders.
Colour Matching
Whilst every effort is made to match colours for icing, ribbon, flowers and other decorations, it is not always possible to match them exactly. Colours will look different in different light (natural, artificial and time of day), on different devices and are also subject to personal interpretation. Southwell Cakery’s colour interpretation is final.
Fresh Flowers
Flowers provided by third parties should be provided wired and arranged, and with the ends sealed ready for insertion into the cake using food safe flower picks or for placing on the cake. They should also be guaranteed no toxic/poisonous, and suitable to be used on a cake. Southwell Cakery reserves the right not to use any flowers that are deemed unsuitable or those which have not been prepared appropriately. 
Cake Toppers and Cake Stands
We accept no liability whatsoever for toppers provided by someone else that do not fit on the cake. Where a client has supplied or wishes to supply a cake stand or any accessories for the wedding cake, Southwell Cakery will set up the cake as per the instructions detailed within the confirmation booking form. Southwell Cakery cannot be held responsible for any issues with a stand that has not been seen or checked for suitability before set up of the cake. Southwell Cakery reserve the right not to use any cake stand supplied by the client or the venue that we feel will not support the cake. In this event we will place the cake directly on the table. Every effort will be made to adhere to the set up instructions as detailed within the confirmation booking form however, in circumstances where this is not appropriate, Southwell Cakery’s decision on set up will be final. Items required for use or to be set up with the cake must be delivered to the studio or at the venue prior to delivery and set up of the cake.
Complaints
In the highly unlikely event you have cause to complain, no cake must be eaten. You (or the venue) must call us immediately and we will collect the cake (if possible) or the cake must be retained (await instructions from us). If the cake is eaten, either wholly or partly (i.e. more than a couple of mouthfuls) we cannot accept any complaint.
Weather / Traffic
Should we be physically unable to deliver your cake in circumstances such as and not limited to: snow, flood, Operation Stack, traffic jams & road closures, hurricane, accidents, we will inform you as soon as possible. We will explore all other roads in order to get you your cake but accept no liability for our inability to deliver the cake or lateness under circumstances that are unforeseen or out of our control.
Storage of your Wedding Cake after delivery
Southwell Cakery recommends that your cake be eaten within a day or two of your wedding, if it has been wrapped well and stored in a sensible way. However, Southwell Cakery takes no responsibility for how you store the cake after your wedding or for the condition of the cake going forward.
